The Act of 7 July 2022, amending the Polish Criminal Code and certain other acts, introduced into Polish criminal law the first modifications to the content of the principles and general directives of judicial imposition of punishment since the formation of the new political system in Poland, significantly modifying the text of Article 53 of the Polish Criminal Code. The legislator’s intervention affected, in particular, the content of the directive of individual prevention, which, in the current state of the law, has been reduced to an obligation to take into account during the imposition of punishment the preventive purposes, which the punishment is intended to achieve in relation to the convicted person, at the same time omitting the educational purposes that were specified until recently. On the pages of this study, an attempt is made to decode the changes that have occurred in the formulation of the content of the individual prevention directive, in particular, by comparing them with the provisions of supra-statutory acts.
