The 2023 amendment to the Polish Criminal Code introduced exceptional criminal liability for 14-year-olds. The rationale of the new provision raises numerous interpretive doubts. Analysis of the essence of the lower age limit of criminal responsibility allows us to conclude that the change is inexpedient. Given the need to protect children’s rights, it is also extremely dangerous.
