Abstract

This article has its roots in one written by John Chown in 2010 (‘Conflicts of Interest and Systemic Risk’ (2010) XXI(2) Central Banking) explaining why malpractices by banks and others should seriously interest not only regulators concerned with attempting to protect the public, but also Central Bankers concerned with prudential regulation. It has been edited and updated for the guidance of professional trustees, with added comments relating to the legal position.
