A Cybernetic Model of Jurisprudence: The Autopoiesis of Legal Norms

Abstract

This project provides the preprint and supporting materials for the paper, "A Cybernetic Model of Jurisprudence." The central goal of this work is to offer a new analytical lens for the philosophy of law, one that is dynamic, integrative, and process-oriented. Traditional jurisprudence often presents legal theories like natural law, legal positivism, and legal realism as mutually exclusive schools of thought. This project challenges that static view by proposing a model where these theories represent distinct, necessary phases within a single, recursive lifecycle of legal norm-creation and adaptation. Drawing on concepts from cybernetics and systems theory, the model frames law as a living system that responds to environmental feedback. It details the journey of a legal norm from its empirical origins as a social problem, through its filtration by societal values and its formal codification, to its ultimate test in real-world application and evaluation. This OSF project is intended to be a hub for this research. It contains: - The most recent version of the preprint PDF. - The LaTeX source code for the paper to ensure transparency and reproducibility. - (Potentially in the future) Related diagrams, presentations, or supplementary materials. The aim is to provide a comprehensive and transparent foundation for a more dynamic and systems-oriented approach to jurisprudence. Feedback and collaboration are welcome.
